OVERVIEW

Ninety Days. One Opportunity. No Room for Error.

An applicant who loses temporary resident status has ninety calendar days from the date status was lost to apply for restoration—this deadline has not changed and Federal Court decisions continue to confirm it is applied strictly, including where the delay resulted from a genuine misunderstanding or an IRCC administrative error in a related letter. Missing the window removes the option entirely and leaves departure from Canada as the remaining course.

Maintained status—formerly called implied status—allows you to remain in Canada under your prior conditions while a timely extension application is pending, but it is not the same as restoration and does not apply once status has already lapsed. Understanding precisely what you may and may not do during that period, including whether you may continue working or studying, is essential and depends on your specific situation.
